These Terms & Conditions govern every booking, shoot, film and delivery undertaken by Foto Phactory, so that both our couples and our team begin the journey with the same clear, honest understanding.

01 Introduction & Acceptance

Introduction

Foto Phactory is a premium wedding photography and cinematic filmmaking studio founded by Sashi Roy and based in Patna, Bihar, India. We work with couples and families who want their most meaningful moments told as a genuine, cinematic story rather than a routine event record. These Terms & Conditions ("Terms") set out the agreement between Foto Phactory ("we," "us," "our," "the Studio") and any individual or entity that books, enquires about, or engages our Services ("you," "the Client").

Acceptance of Terms

By submitting a booking form, paying an advance, signing a service agreement, or otherwise instructing Foto Phactory to provide any Service, you confirm that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy. Where a signed contract or quotation exists for your specific booking, that document takes precedence over these Terms to the extent of any conflict, and these Terms apply to fill any gaps it does not address.

Definitions

  • "Services" means any photography, cinematography, drone coverage, editing, album design, or related creative service offered by Foto Phactory.
  • "Package" means the specific combination of Services, hours, deliverables, and team size agreed in your quotation.
  • "Event" means the wedding function, ceremony, shoot, or occasion for which Services are booked.
  • "Deliverables" means the final edited photographs, films, albums, and digital files provided to the Client.
  • "Advance" means the initial payment made to confirm and block a booking date.
  • "Working Days" excludes Sundays and public holidays observed in Bihar, India.

Eligibility

Our Services may be booked only by individuals who are at least 18 years of age and legally capable of entering into a binding contract under Indian law, or by an authorised representative acting on behalf of the couple or family (such as a parent, planner, or event coordinator).

02 Scope of Services & Booking

Scope of Services

Foto Phactory offers luxury wedding photography, wedding cinematography and films, pre-wedding photography, engagement, haldi, mehendi and reception coverage, destination, traditional and intimate wedding storytelling, maternity, baby and birthday photography, couple shoots, family portraits, corporate and product photography, commercial and brand films, and drone photography. The exact Services included in your booking are those specified in your written quotation or booking confirmation, and no Service outside that scope is implied.

Booking Confirmation

A booking is considered confirmed only once (a) you have received a written quotation or Package summary from us, and (b) we have received the applicable Advance payment as described in Section 3. Verbal discussions, WhatsApp conversations, or informal enquiries do not, by themselves, constitute a confirmed booking or guarantee our availability on your Event date.

Quotation Validity

Quotations shared by Foto Phactory are valid for 15 calendar days from the date of issue, unless stated otherwise. Pricing may be revised after this period to reflect seasonal demand, team availability, or updated Package inclusions.

Package Inclusions

Each Package clearly states the number of photographers and cinematographers, coverage hours, drone availability, number of edited photographs, film formats, and album specifications included. Only the items explicitly listed in your quotation form part of your Package.

Package Exclusions

Unless expressly included in writing, the following are excluded from standard Packages: additional coverage hours beyond the agreed schedule, travel and accommodation outside Patna, government or venue permission fees, printed albums beyond the included quantity, raw or unedited files, and expedited "rush" delivery.

Customization Requests

We welcome requests to customise a Package — additional shoot days, a second cinematographer, a longer film, or a larger album. Customisation requests are quoted separately and confirmed only once agreed in writing and, where applicable, an additional advance is received.

03 Payments & Charges

Advance Payment Policy

A non-refundable advance of 30% of the total Package value is required to confirm your booking and reserve your Event date exclusively for you. Once received, we stop accepting other enquiries for that date, which is why this advance is non-refundable in the event of a cancellation by the Client.

Balance Payment Policy

The remaining balance is payable in the instalments agreed in your quotation, with the final balance due on or before the day of the Event, unless a different schedule has been agreed in writing. Deliverables are processed and released only after the full Package amount has been received.

Payment Gateway

Payments may be made via bank transfer, UPI, or a secure third-party payment gateway. Where a gateway is used, your card or banking details are processed directly and securely by that provider; Foto Phactory does not store your complete card number, CVV, or net-banking credentials.

Taxes & GST

All quoted prices are exclusive of applicable Goods and Services Tax (GST) unless explicitly stated as tax-inclusive. GST, where applicable, will be added to your invoice at the prevailing rate under Indian tax law.

Travel Charges

For Events outside Patna, travel charges for our team (flights, train fares, or road transport) are billed separately based on the actual distance and mode of travel, and are shared with you as part of your destination quotation.

Accommodation Charges

Comfortable accommodation for our photography and cinematography team must be arranged and covered by the Client for any Event requiring overnight stay, or the equivalent cost may be added to your invoice if arranged by us on your behalf.

Additional Hours Charges

Coverage extending beyond the hours specified in your Package is charged at our prevailing hourly rate, payable on the day of the Event or within 3 Working Days thereafter.

04 Events, Venues & Permissions

Destination Wedding Policy

For destination weddings, the Client is responsible for sharing accurate venue details, local logistics, and any travel advisories at least 30 days before the Event. Travel, accommodation, and, where applicable, visa costs for our team are quoted and billed in addition to the core Package.

Event Schedule

The Client must share a detailed Event schedule (timings for each ceremony or function) at least 7 days prior to the Event, so our team can plan coverage accordingly. Significant last-minute changes to the schedule may affect the quality or completeness of coverage and are outside our control.

Venue Permissions

The Client is responsible for obtaining any permissions required from the venue for photography, videography, drone use, or equipment such as lighting and tripods. Foto Phactory is not liable for restrictions imposed by a venue that limit our ability to deliver the full scope of coverage.

Government Permissions

Where an Event location requires government or local authority permission for filming (such as heritage sites, forts, or public monuments), obtaining such permission is the Client's responsibility unless otherwise agreed in writing.

Drone Photography Rules

Our drone photography operates in accordance with Directorate General of Civil Aviation (DGCA) regulations under India's Digital Sky framework. Drone coverage is subject to weather conditions, no-fly zones (including proximity to airports, defence establishments, and certain government buildings), and venue consent. We reserve the right to decline or discontinue drone operation at any time on safety or legal grounds, without liability for any resulting gap in coverage.

05 Roles & Responsibilities

Client Responsibilities

  • Providing accurate Event details, schedules, and venue information in a timely manner
  • Ensuring our team has safe, reasonable access to shoot locations
  • Making payments as per the agreed schedule
  • Informing guests, family, and vendors of the presence of our photography and cinematography team
  • Communicating any specific requirements (religious customs, restricted moments, family sensitivities) in advance

Photographer Responsibilities

Our photographers are responsible for covering the agreed Event as per the Package, using professional judgment to capture key moments, and delivering edited photographs within the timelines described in Section 10. Creative and stylistic decisions during editing remain within the photographer's professional discretion, consistent with the Foto Phactory aesthetic shown in our portfolio.

Videographer Responsibilities

Our cinematography team is responsible for capturing audio-visual coverage as per the Package, including any highlight film, teaser, or feature film agreed in your quotation, and delivering final edits within the agreed timelines.

Equipment Usage

Foto Phactory uses professional-grade cameras, lenses, audio equipment, lighting, and drones appropriate to each Event. Equipment selection for a given assignment remains at our professional discretion, based on venue, lighting, and coverage requirements.

Backup Equipment

We carry backup cameras, batteries, memory cards, and audio recorders to every Event as standard practice, to reduce the risk of coverage disruption due to equipment issues.

06 Force Majeure & Unforeseen Events

Force Majeure

Neither party shall be held liable for any delay or failure to perform obligations under these Terms where such delay or failure results from circumstances beyond reasonable control, including but not limited to natural disasters, extreme weather, government restrictions, civil unrest, strikes, pandemics, or health emergencies ("Force Majeure Event").

Where a Force Majeure Event affects an Event, both parties agree to act in good faith to reschedule coverage at the earliest mutually convenient opportunity, rather than treating the disruption as a breach of contract.

Weather Conditions

Outdoor shoots, pre-wedding sessions, and drone coverage are inherently weather-dependent. In the event of rain, storms, or unsafe conditions, our team will adapt coverage where possible, or work with you to reschedule the affected portion of the shoot.

Natural Disasters

In the event of floods, earthquakes, or similar natural disasters affecting the Event location or our team's ability to travel safely, Services will be rescheduled without penalty to either party, subject to mutual agreement on a revised date.

Government Restrictions

Where government orders, curfews, or public gathering restrictions prevent an Event from proceeding as planned, Foto Phactory will reschedule Services to a mutually agreed date without treating the disruption as a cancellation.

Health Emergencies

In the case of a serious illness or medical emergency affecting the Client, an immediate family member, or our assigned team member, both parties agree to reschedule coverage in good faith, supported by reasonable documentation where requested.

07 Cancellation, Rescheduling & Attendance

The Advance payment described in Section 3 is non-refundable under all cancellation circumstances, as it directly reflects the loss of alternative bookings for your reserved date.

Event Rescheduling

We allow one rescheduling request free of charge, provided we are notified at least 30 days in advance and our team is available on the proposed new date. Your Advance and any payments made are carried forward to the new date. Requests made within 30 days of the original Event, or a second rescheduling request, may attract an additional administrative charge.

No Show Policy

If our team arrives at the agreed venue and time and coverage cannot commence due to the Client's or Event's non-availability (with no prior notice), the full Package amount remains payable, and no refund or credit will be issued for the missed session.

Late Arrival Policy

Where an Event runs significantly later than the schedule shared under Section 4 without prior notice, our team will make reasonable efforts to accommodate the delay, but is not obligated to extend coverage beyond contracted hours without an agreed additional charge.

08 Raw Files, Editing & Post-Production

Raw Photo Policy

Raw, unedited photograph files are not included in standard Packages. Foto Phactory's work is defined by our curated editing style, and we do not release unedited images that do not reflect our final creative and quality standards, except where separately agreed in writing at an additional charge.

RAW Video Policy

Similarly, raw or unedited video footage is not part of standard Packages. Raw footage may only be released where explicitly agreed in a signed contract, typically for archival purposes and at an additional fee.

Editing Policy

All Deliverables are professionally edited by our in-house team in line with the Foto Phactory luxury aesthetic — warm natural tones, golden-hour colour balance, and editorial composition, as reflected in our portfolio.

Color Grading Policy

Colour grading is applied consistently across each Event to achieve a cohesive visual narrative. Individual colour-grading preferences may be discussed at the time of booking but final creative execution rests with our editing team.

Retouching Policy

Standard retouching (skin tone balancing, minor blemish correction, lighting adjustment) is included. Extensive retouching requests (such as significant body reshaping) are handled on a case-by-case basis and may involve an additional charge.

Revision Policy

Each Package includes one round of reasonable revisions to the wedding film and album design. Additional revision rounds, or requests that significantly alter the original edit or design, are chargeable at our standard revision rate.

09 Albums & Printing

Album Designing

Where a Package includes a printed album, our design team curates a layout from the edited photograph selection, balancing storytelling flow with the visual identity of your Event.

Album Approval

A digital proof of the album layout is shared for the Client's review and approval before printing. Printing begins only after written approval is received; any changes requested after printing has commenced are billed separately.

Printing Policy

Albums are printed using premium, professional-grade materials appropriate to a luxury product. Minor variations in colour between screen proofs and printed output may occur due to the nature of print reproduction and are not considered a defect.

Timelines may vary during the peak wedding season (October to February) and will be communicated in advance where a delay beyond the above ranges is expected.

Photo Delivery

Final edited photographs are delivered via an online cloud gallery, with the option of a USB delivery as specified in your Package.

Video Delivery

Wedding films are delivered in high-definition digital format via cloud link or USB, as agreed in your Package.

Highlight Film Delivery

Where included, the highlight film is delivered alongside or shortly after the full wedding film, edited to a shorter, cinematic runtime for easy sharing.

Teaser Delivery

A short teaser or social-media preview is typically delivered within 7 to 10 Working Days of the Event, so you can share a first glimpse with family and friends.

Cloud Gallery Delivery

Cloud galleries remain active for the period specified in your Package (typically 6 to 12 months) from the date of delivery. Clients are encouraged to download and back up their files promptly, as gallery access is not guaranteed indefinitely.

USB Delivery

Where a Package includes USB delivery, files are couriered to the address provided by the Client. Foto Phactory is not responsible for delays or loss caused by third-party courier services once dispatched.

Album Delivery

Printed albums are delivered or couriered following final printing, typically within the timeline specified in Section 10's delivery table above.

12 Privacy & Data Protection

Privacy

Personal information collected during booking and Event coverage is handled in accordance with our Privacy Policy, which forms part of these Terms by reference.

Data Protection

We process personal data in line with India's Digital Personal Data Protection Act, 2023, and, where applicable to international clients, the GDPR and CCPA. We do not sell client personal data to third parties.

Third Party Vendors

Where we engage associate photographers, editors, printers, or courier partners to fulfil your Package, such third parties are bound by confidentiality obligations consistent with this Section.

13 Liability, Risk & Indemnity

Limitation of Liability

To the maximum extent permitted under applicable Indian law, including the Consumer Protection Act, 2019, Foto Phactory's total liability for any claim arising from these Terms shall not exceed the total Package amount paid by the Client for the relevant Event. We are not liable for indirect, incidental, or consequential losses.

Equipment Failure

While we carry backup equipment as described in Section 5, Foto Phactory shall not be held liable for coverage gaps resulting from equipment failure that occurs despite reasonable professional precautions.

File Corruption

In the rare event of file corruption affecting captured footage or photographs, Foto Phactory will make all reasonable technical efforts to recover the affected files, but cannot guarantee full recovery and shall not be liable beyond such reasonable efforts.

Data Backup

We maintain backup copies of captured and edited files for the storage period described below. Clients are strongly encouraged to download and independently back up their Deliverables promptly upon receipt.

Storage Duration

Foto Phactory retains a backup of final Deliverables for 12 months from the date of delivery, after which files may be archived or removed from active storage. Extended storage may be arranged on request at an additional charge.

Indemnification

The Client agrees to indemnify Foto Phactory against claims, losses, or damages arising from inaccurate information provided by the Client, failure to obtain required venue or government permissions, or any breach of these Terms by the Client.

14 Termination & Disputes

Termination of Services

Foto Phactory reserves the right to decline or discontinue Services in cases involving abusive conduct toward our team, non-payment as per the agreed schedule, or unsafe working conditions, without prejudice to amounts already due.

Dispute Resolution

In the event of a dispute, both parties agree to first attempt an amicable resolution through direct discussion. If unresolved within 30 days, the matter may be referred to mediation or arbitration in Patna, Bihar, in accordance with the Arbitration and Conciliation Act, 1996.

Jurisdiction

Subject to the above, these Terms shall be subject to the exclusive jurisdiction of the courts at Patna, Bihar, India.

Applicable Law

These Terms are governed by the laws of India, including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Information Technology Act, 2000, the Copyright Act, 1957, and the Digital Personal Data Protection Act, 2023.

15 Changes to These Terms

Foto Phactory may update these Terms from time to time to reflect changes in our Services, industry practice, or legal requirements. The updated version will be published on this page with a revised "Last Updated" date. Terms agreed in a signed booking contract for an existing Event remain governed by the version in effect at the time of that booking, unless both parties agree otherwise in writing.

17 Frequently Asked Questions

How much advance payment does Foto Phactory require to confirm a wedding booking?

We require a non-refundable advance of 30% of the total Package value to block your date. This confirms your booking and removes your wedding date from our availability calendar.

How long does it take to receive edited wedding photos and films?

Edited photographs are typically delivered within 45 to 60 Working Days, and wedding films within 60 to 90 Working Days, depending on the season and Package scope. A teaser is usually shared within 7 to 10 Working Days.

Does Foto Phactory provide raw, unedited photos and video files?

Raw files are not part of our standard Packages, as our brand is built on curated, professionally edited storytelling. Raw files may be provided only if specifically agreed in writing, typically at an additional charge.

Who owns the copyright of the wedding photographs and films?

Foto Phactory retains copyright ownership of all original photographs and films as the creator of the work, in line with the Copyright Act, 1957. Clients receive a broad personal-use licence to print, share, and display their delivered media.

Can Foto Phactory use our wedding photos on Instagram or the website?

Yes, unless you opt out in writing before your Event. We may feature select images and clips from your wedding in our portfolio, website, and social media as part of our standard marketing usage.

What happens if the wedding date needs to be rescheduled?

We allow one rescheduling request at no extra charge, subject to team availability on the new date, provided we are notified at least 30 days in advance. Your advance payment is carried forward to the new date.

Is drone photography legal for weddings in India?

Yes, subject to Directorate General of Civil Aviation (DGCA) regulations. We operate registered drones within permitted zones and altitudes, and venue or local permissions are the Client's responsibility where required, such as near airports or restricted areas.

What if it rains or weather disrupts an outdoor pre-wedding or wedding shoot?

Weather is treated as a Force Majeure event. We adapt our coverage plan on the day wherever possible; if the shoot must be postponed entirely, we work with you to reschedule at the earliest mutually convenient date.

How many revisions are included in the wedding film and album design?

Our Packages include one round of reasonable revisions to the wedding film and album layout. Additional revision rounds beyond the included scope may attract an additional charge, as outlined in your Package agreement.

Does Foto Phactory travel for destination weddings outside Patna?

Yes, we cover destination weddings across India and internationally. Travel, accommodation, and any applicable visa costs for the team are billed separately from the core photography and cinematography Package.

What happens if Foto Phactory's equipment fails during the Event?

We carry backup cameras, lenses, audio recorders, and storage cards to every assignment to minimise disruption. In the rare event of an unavoidable equipment failure, we use all reasonable efforts to continue coverage using backup gear.
